Acceptance of the terms

By creating a Cakesily account or using Cakesily, you agree to these Terms of Service. If you do not agree, do not create an account or use the service. Cakesily is operated by FAMZON LLC.

Eligibility and account responsibility

You must be able to form a binding contract under applicable law and comply with these Terms. You are responsible for your account, for keeping your sign-in secure, and for all activity under your account.

About Cakesily

Cakesily is a subscription service that helps home bakers and cake decorators calculate costs and prices, create quotes, manage clients and inquiries, track orders and deposits, and organize a calendar.

Subscription and 14-day free trial

Cakesily offers a 14-day free trial. No payment method is required to start the trial. After the trial, a subscription is $9.99 per month. Your bakery data stays saved during the trial and whether or not you subscribe.

Monthly renewal

A paid subscription renews automatically each month until you cancel. Renewal is processed through your selected billing method (Apple for App Store subscriptions, Stripe for web subscriptions).

Cancellation

Web subscription: cancel anytime from the billing portal linked in your Cakesily account.
App Store subscription: cancel anytime from your Apple ID subscription settings.

After cancellation, your access continues until the end of the current paid period. You will not be charged again for a canceled subscription.

App Store and Apple billing

The Cakesily iOS app is distributed through Apple’s App Store. In-app subscriptions are billed by Apple under Apple’s terms. For the Apple-provided software, Apple’s standard End User License Agreement (EULA) applies. Apple’s EULA governs the Apple-provided software; these Terms govern the Cakesily service and your use of it.

Web subscriptions

Web subscriptions are supported and are processed by Stripe. You manage web billing and cancellation through your Cakesily account and the billing portal.

Refunds

App Store payments are governed by Apple’s terms and policies; refund requests for App Store subscriptions should be directed to Apple. Web subscription billing is handled by Stripe and managed through the billing portal. Cakesily does not provide refunds beyond what Apple, Stripe, or applicable law require, and nothing here overrides Apple’s refund policies.

Your business and customer data

You are responsible for the accuracy and legality of the business and customer information you enter into Cakesily, and for having the rights to use it. You retain your rights to your content. You grant Cakesily a limited license to host, process, and display your content only as needed to operate the features you use.

Acceptable use

Do not enter unlawful content or content that infringes someone else’s rights.
Do not spam, misuse, or attempt to access systems you are not authorized to use.
Respect customer privacy and applicable law when entering customer information.
Do not use Cakesily to mislead customers or misrepresent prices.

Intellectual property

Cakesily, its name and branding, and its software are owned by FAMZON LLC or its licensors. These Terms do not grant you any rights to Cakesily’s intellectual property except the limited right to use the service.

User-generated content

You are responsible for the content you upload, including images and customer details. Cakesily may remove content that violates these Terms or applicable law.

Availability and changes to the service

We may change, suspend, or discontinue features at any time. We do not guarantee that Cakesily will be uninterrupted or error-free.

Pricing calculation disclaimer

Cakesily provides calculation and organizational tools. Suggested prices depend on information entered by the user and are not guarantees of profit, accuracy, tax compliance, or business performance. Bakers remain responsible for reviewing and approving all prices and customer-facing information.

Your responsibility

You are responsible for reviewing and approving all suggested prices, for handling taxes, and for complying with food-safety laws, licensing, labeling, allergen, and customer-agreement requirements that apply to your business. Cakesily does not provide legal, tax, accounting, or food-safety advice.

Limitation of liability

To the extent permitted by law, Cakesily and FAMZON LLC are not liable for indirect or consequential damages arising from your use of the service, or for any amount greater than what you paid Cakesily in the twelve months before the claim.

Warranty disclaimer

The service is provided “as is” and “as available.” To the extent permitted by law, we disclaim all warranties, including any warranty of merchantability, fitness for a particular purpose, or that the service will be error-free.

Termination

You can stop using Cakesily at any time. We may suspend or terminate accounts that violate these Terms or applicable law.

Changes to these terms

We may update these Terms and will show the effective date on this page. By continuing to use Cakesily after changes take effect, you accept the updated Terms.

These Terms do not select a governing law, court jurisdiction, arbitration provision, or class-action waiver. If any of those becomes necessary, they will be added with notice on this page.
